Terms of Service

By using services provided at bcsnotify.com or receiving email delivered by our infrastructure, you agree to the following terms.

1. Service description

BCS Notify operates transactional and permissioned marketing email infrastructure on behalf of contracted business clients. We do not send unsolicited commercial messages ("spam"). Every recipient in our system has provided verifiable consent through a double opt-in process operated either by us or by a contracted client.

2. Acceptable use

Clients using our infrastructure agree not to:

  • Send messages to purchased, harvested or scraped lists.
  • Impersonate any brand, entity or individual.
  • Send content that is illegal, deceptive, or promotes prohibited goods.
  • Bypass unsubscribe or suppression records.

Violations result in immediate account suspension.

3. Recipient rights

All recipients have the unconditional right to:

  • Unsubscribe at any time via the one-click link in every message.
  • Request deletion of their record by contacting [email protected].
  • Report abuse via [email protected] — investigated within 24 hours.

4. Deliverability commitments

We make reasonable efforts to maintain sender reputation across major mailbox providers (Gmail, Outlook, Yahoo, AOL, Yandex) but do not guarantee inbox placement for any specific message. Reputation depends on content, list quality and recipient engagement, all of which we monitor continuously.

5. Data processing

Personal data handled by our infrastructure is processed in accordance with the Privacy Policy.

6. Limitation of liability

To the maximum extent permitted by law, BCS Notify shall not be liable for indirect, incidental or consequential damages arising from the use of our services. Total liability is limited to fees paid in the twelve months preceding the claim.

7. Governing law

These terms are governed by the laws of the Republic of Armenia. Disputes shall be resolved in the courts of Yerevan unless otherwise agreed in writing.

8. Changes

We may update these terms with 30 days' notice via a banner on this page. Continued use after the notice period constitutes acceptance.
